The Washington State Office of the Attorney General (AGO) is seeking an experienced attorney and outstanding manager with significant understanding of state government and/or education law to fill the position of Division Chief of its Education Division.  The Education Division Chief is a member of the AGO Leadership Team and responsible for contributing to and supporting the overall mission of the AGO.

Duties

ABOUT THE POSITION
The Education Division is responsible for providing comprehensive legal services to the State’s education agencies for both K-12 and higher education (with the exception of the University of Washington (UW) and the Washington State University (WSU).  Clients include the Superintendent of Public Instruction, a separately elected constitutional officer; the State Board of Education; the State Board for Community and Technical Colleges; Central Washington University; Eastern Washington University; The Evergreen State College; Western Washington University; 34 community and technical colleges around the state; and several other smaller educational governance agencies. The practice is extremely diverse and includes both client advice and litigation (under the APA and in state courts). Practice areas include, but are not limited to, education system governance, open public meetings, public records, administrative law, student affairs, business transactions and procurement, labor and employment law, data privacy, constitutional law and property issues.
 
The Division Chief oversees and manages all aspects of the Division, including the work of 14 outstanding employees – ten attorneys and four professional staff, including an administrative manager and two section chiefs.  The Division Chief also devotes significant time coordinating with 15 other part-time and full-time education attorneys in other AGO office locations around the state, who serve colleges and universities located in their region. The Division Chief also manages the division’s budget.
 
Additionally, the Division Chief provides legal advice and representation to client agencies, which includes serving as lead counsel to the State Board for Community and Technical Colleges. The Division Chief is expected to understand client agencies’ roles within state government and to keep up with emerging issues in education.  The Division Chief must be able to build and maintain strong relationships and coordinate effectively with clients and all members of the division as well as with managers and other employees in other AGO divisions, including those serving the UW and WSU.  
 
The Division Chief is required to build trust with coworkers and clients and have superior interpersonal skills and strong oral and written communication skills. The Division Chief is expected to foster teamwork, provide growth opportunities for a diverse group of people, and promote and maintain an equitable, inclusive and welcoming work environment. The successful candidate will be an outstanding leader and team player.  
 

The Division's primary location is located in Olympia, Washington, but it also has a location in Seattle, Washington.  Regular travel between both locations and occasional travel to other office locations throughout the state is required.

Qualifications

In addition to meeting the requirements to apply and serve as an Assistant Attorney General, the ideal candidate will offer:

  • at least 8 years of legal experience practicing law;
  • a strong interest in education law;
  • excellent judgment and leadership/management skills;
  • exceptional communication skills (verbal and in writing);
  • high caliber analytical and research skills with an affinity for quickly learning new areas of law;
  • superior interpersonal skills;
  • strong organizational skills and a demonstrated ability to manage multiple priorities under pressure;
  • experience providing independent, sound legal advice on a wide variety of complex issues to knowledgeable high level clients;
  • an outstanding ability to establish and maintain positive working relationships with coworkers and clients;
  • a demonstrated ability to collaborate effectively and foster teamwork;
  • effective problem solving skills;
  • experience providing proactive, practical and creative solutions relating to legal, business and operational strategy and/or to law office management; and
  • demonstrated ability to facilitate issue resolution in a highly visible environment.
 
The strongest candidates also will possess:
  • substantial experience serving in effective leadership and management roles as an attorney;
  • significant experience advising a higher education institution or a large public or governmental entity;
  • significant and demonstrated understanding of state government;
  • civil litigation experience; and
  • experience with open public meetings and public records laws as well as administrative law, and/or experience in other practice areas listed in the division description above.

Applicants must have graduated from a law school accredited by the ABA or completed the WSBA's Rule 6 Law Clerk Program and be licensed to practice law in Washington state. Supplemental Information

Minimum salary for this position is $135,000. However, Division Chief salaries are based on experience, qualifications and are commensurate with comparable positions in the AGO. This position is exempt from representation by the Association of Washington Assistant Attorneys General/Washington Federation of State Employees AFSCME Council 28, AFL-CIO. A competitive state benefits package is also offered which includes a choice of medical/dental insurance plans, retirement, life and basic long-term disability insurance. Insurance Benefits

Retirement and Deferred Compensation
State Employees are members of the Washington Public Employees' Retirement System (PERS).  New employees have the option of two employer contributed retirement programs.  For additional information, check out the Department of Retirement Systems' web site.

Employees also have the ability to participate in the Deferred Compensation Program (DCP).  This is a supplemental retirement savings program (similar to an IRA) that allows you control over the amount of pre-tax salary dollars you defer as well as the flexibility to choose between multiple investment options.

Social Security
All state employees are covered by the federal Social Security and Medicare systems. The state and the employee pay an equal amount into the system.

Public Service Loan Forgiveness
If you are employed by a government or not-for-profit organization, and meet the qualifying criteria, you may be eligible to receive student loan forgiveness under the Public Service Loan Forgiveness Program.

Holidays
Full-time and part-time employees are entitled to paid holidays and one paid personal holiday per calendar year.

Note: Employees who are members of certain Unions may be entitled to additional personal leave day(s), please refer to position specific Collective Bargaining Agreements for more information.

Full-time employees who work full monthly schedules qualify for holiday compensation if they are employed before the holiday and are in pay status for at least 80 nonovertime hours during the month of the holiday; or for the entire work shift preceding the holiday.

Part-time employees who are in pay status during the month of the holiday qualify for the holiday on a pro-rata basis. Compensation for holidays (including personal holiday) will be proportionate to the number of hours in pay status in the month to that required for full-time employment, excluding all holiday hours. Pay status includes hours worked and time on paid leave.

Sick Leave
Full-time employees earn eight hours of sick leave per month. Overtime eligible employees who are in pay status for less than 80 hours per month, earn a monthly proportionate to the number of hours in pay status, in the month to that required for full-time employment. Overtime exempt employees who are in pay status for less than 80 hours per month do not earn a monthly accrual of sick leave.

Sick leave accruals for part-time employees will be proportionate to the number of hours in pay status, in the month to that required for full-time employment. Pay status includes hours worked, time on paid leave and paid holiday.

Vacation (Annual Leave)
Full-time employees accrue vacation leave at the rates specified in WAC 357-31-165(1) or the applicable collective bargaining agreement (CBA). Full-time employees who are in pay status for less than 80 nonovertime hours in a month do not earn a monthly accrual of vacation leave.

Part-time employees accrue vacation leave hours in accordance with WAC 357-31-165(1) or the applicable collective bargaining agreement (CBA) on a pro rata basis. Vacation leave accrual will be proportionate to the number of hours in pay status, in the month to that required for full-time employment.

Pay status includes hours worked, time on paid leave and paid holiday.


As provided in WAC 357-58-175, an employer may authorize a lump-sum accrual of vacation leave or accelerate the vacation leave accrual rate to support the recruitment and/or retention of a candidate or employee for a Washington Management Service position. Vacation leave accrual rates may only be accelerated using the rates established WAC 357-31-165. 

Note: Most agencies follow the civil service rules covering leave and holidays for exempt employees even though there is no requirement for them to do so. However, agencies are required to adhere to the applicable RCWs pertaining holidays and leave.

Military Leave
Washington State supports members of the armed forces with 21 days paid military leave per year.

Bereavement Leave
Most employees whose family member or household member dies, are entitled to three (3) days of paid bereavement leave. In addition, the employer may approve other available leave types for the purpose of bereavement leave.
