The Public Lands and Conservation Division of the Attorney General’s Office seeks to fill two Assistant Attorney General positions. The Public Lands and Conservation Division provides a broad spectrum of client advice, dispute resolution, and litigation services to agency clients in legal matters before state and federal courts and administrative tribunals. The division represents the Commissioner of Public Lands, the Department of Natural Resources (DNR), the Board of Natural Resources, the Forest Practices Board, the Department of Fish and Wildlife (WDFW), and the State Parks and Recreation Commission (Parks).

Duties

One position is in the DNR Proprietary Section, reporting to the DNR Proprietary Section Chief. This section represents the Department of Natural Resources in its land management planning, transactions, contracts, and other proprietary decisions. DNR manages 5.6 million acres of forest, range, commercial, agricultural, and aquatic lands. Much of this land (3 million acres) is state trust land that provides revenue to help pay for construction of public schools, universities, and other state institutions and funds services in many counties. These lands also provide other public benefits, including outdoor recreation, habitat for native fish and wildlife, and watersheds for clean water.

Practice areas include real property, contracts, environmental, natural resource, and constitutional law. Typical client work might include:


  • Reviewing draft leases, easements, and other documents authorizing the use of state-managed lands or the sale of valuable materials. Providing advice on legal issues that arise, including assignments, security issues, amendments, and default;
  • Providing advice on public works contracts, and permits related to engineering projects;
  • Assisting DNR in land transactions;
  • Providing legal review on legislative proposals or DNR policy decisions;
  • Providing advice on compliance with environmental laws, including the National and State Environmental Policy Acts (NEPA/SEPA), state and federal cleanup laws (CERCLA and MTCA), the Clean Water Act (CWA), and the Endangered Species Act (ESA); and
  • Litigation on any of these issues.
 
The second position is in the Fish, Wildlife & Parks Section, reporting to the Fish, Wildlife & Parks Section Chief. This Section provides legal services to WDFW and Parks on a broad and complex array of natural resource and land management issues, criminal matters arising from client agency enforcement actions, and assisting local prosecutors in charging violations of the state Fish and Wildlife Code. Client agency issues include hunting and fishing regulation, endangered species, habitat protection, rule adoption (Administrative Procedure Act), hydropower licensure, law enforcement, risk management, real property transactions and management, public works, concessions, and other contracts. The Section deals extensively with tribal hunting and fishing issues and cultural resource issues.
 
Duties typical of attorneys within the Public Lands and Conservation Division include:
 
  • Providing options-based client advice, both oral and written;
  • Appearance in federal and state courts across the state and in proceedings before administrative tribunals, such as the Pollution Control Hearings Board, the Shorelines Hearings Board, or FERC;
  • Motions practice, trials, and participating in post-trial proceedings including any appeals;
  • Conducting all aspects of discovery;
  • Representing the AGO in public settings on matters that may be of a sensitive or high-profile nature;
  • Directing and assisting in investigations; and
  • Working individually and as part of a team.
 
These positions may require travel, including overnight trips. The Office is currently working remotely and the people hired to these positions will primarily telecommute full time until we transition back to working in-person in Olympia.

Qualifications

In addition to meeting the requirements to serve as an Assistant Attorney General, requirements for these positions include:
 

  • Three or more years of legal experience are required;
  • Litigation experience in state and federal courts and administrative proceedings is preferred;
  • Experience in complex natural resource or environmental advice and litigation;
  • Strong analytical, research, and writing skills;
  • Strong organizational skills and the ability to handle competing, time-sensitive assignments; 
  • Demonstrated ability to foster teamwork and collaboration and promote a positive work environment that recognizes and respects all employees; and
  • Ability to maintain productive working relationships within the division and with clients and stakeholders, helping to identify and resolve problems.
 
Applicants must have graduated from a law school accredited by the ABA or completed the WSBA's Rule 6 Law Clerk Program and be licensed to practice law in Washington state. (Applicants who meet the other stated qualifications and are actively pursuing admission by motion will also be considered.) 8/19/21 COVID Update!
Please note that the AGO’s original target date to re-open our offices for visitors and staff was set for September 13, 2021.  In consideration of recent developments with the pandemic, we have decided to push our target re-open date out to October 18, 2021. Otherwise, our strategy remains as outlined in the previous update below.
 

Covid Update!
We feel it is important to share our return to work plans as you consider joining our team. The location of each position is noted on every posting; however currently all staff, whose duties permit, are teleworking. The AGO is planning to re-open its offices for visitors and staff beginning September 13, 2021. Additionally, a draft policy is being reviewed for possible adoption that will require all staff to be vaccinated as a qualifying fitness for duty. Staff precluded from vaccinations due to medical conditions and/or sincerely held religious beliefs will have opportunity to engage with Human Resources to explore reasonable accommodation. Applicants or candidates being considered for employment shall not share their vaccination status with hiring managers or interview panels.

These Assistant Attorney General positions are represented by the Association of Assistant Attorneys General (AWAAG) / Washington Federation of State Employees (WFSE) AFSCME Council 28, AFL-CIO. AAG salaries start at $69,396. Ultimately, AAG salaries are set in accordance with the AWAAG CBAA competitive state benefits package is also offered which includes a choice of medical/dental insurance plans, retirement, life and basic long-term disability insurance. Insurance Benefits

Retirement and Deferred Compensation
State Employees are members of the Washington Public Employees' Retirement System (PERS).  New employees have the option of two employer contributed retirement programs.  For additional information, check out the Department of Retirement Systems' web site.

Employees also have the ability to participate in the Deferred Compensation Program (DCP).  This is a supplemental retirement savings program (similar to an IRA) that allows you control over the amount of pre-tax salary dollars you defer as well as the flexibility to choose between multiple investment options.

Social Security
All state employees are covered by the federal Social Security and Medicare systems. The state and the employee pay an equal amount into the system.

Public Service Loan Forgiveness
If you are employed by a government or not-for-profit organization, and meet the qualifying criteria, you may be eligible to receive student loan forgiveness under the Public Service Loan Forgiveness Program.

Holidays
Full-time and part-time employees are entitled to paid holidays and one paid personal holiday per calendar year.

Note: Employees who are members of certain Unions may be entitled to additional personal leave day(s), please refer to position specific Collective Bargaining Agreements for more information.

Full-time employees who work full monthly schedules qualify for holiday compensation if they are employed before the holiday and are in pay status for at least 80 nonovertime hours during the month of the holiday; or for the entire work shift preceding the holiday.

Part-time employees who are in pay status during the month of the holiday qualify for the holiday on a pro-rata basis. Compensation for holidays (including personal holiday) will be proportionate to the number of hours in pay status in the month to that required for full-time employment, excluding all holiday hours. Pay status includes hours worked and time on paid leave.

Sick Leave
Full-time employees earn eight hours of sick leave per month. Overtime eligible employees who are in pay status for less than 80 hours per month, earn a monthly proportionate to the number of hours in pay status, in the month to that required for full-time employment. Overtime exempt employees who are in pay status for less than 80 hours per month do not earn a monthly accrual of sick leave.

Sick leave accruals for part-time employees will be proportionate to the number of hours in pay status, in the month to that required for full-time employment. Pay status includes hours worked, time on paid leave and paid holiday.

Vacation (Annual Leave)
Full-time employees accrue vacation leave at the rates specified in WAC 357-31-165(1) or the applicable collective bargaining agreement (CBA). Full-time employees who are in pay status for less than 80 nonovertime hours in a month do not earn a monthly accrual of vacation leave.

Part-time employees accrue vacation leave hours in accordance with WAC 357-31-165(1) or the applicable collective bargaining agreement (CBA) on a pro rata basis. Vacation leave accrual will be proportionate to the number of hours in pay status, in the month to that required for full-time employment.

Pay status includes hours worked, time on paid leave and paid holiday.


As provided in WAC 357-58-175, an employer may authorize a lump-sum accrual of vacation leave or accelerate the vacation leave accrual rate to support the recruitment and/or retention of a candidate or employee for a Washington Management Service position. Vacation leave accrual rates may only be accelerated using the rates established WAC 357-31-165. 

Note: Most agencies follow the civil service rules covering leave and holidays for exempt employees even though there is no requirement for them to do so. However, agencies are required to adhere to the applicable RCWs pertaining holidays and leave.

Military Leave
Washington State supports members of the armed forces with 21 days paid military leave per year.

Bereavement Leave
Most employees whose family member or household member dies, are entitled to three (3) days of paid bereavement leave. In addition, the employer may approve other available leave types for the purpose of bereavement leave.
