- An alien shall apply to the Agency for a residence permit in Georgia 40 calendar days before the expiration of his/her lawful stay in Georgia. (This requirement does not apply to lifelong residence permits, investment residence permits, special residence permits, temporary residence permits (victims of domestic violence) and short-term residence permits, as well as to an alien staying in another country, wishing to apply the Agency in electronic form for extension of his/her residence permit in Georgia).
- A residence permit in Georgia is issued to an alien lawfully staying in Georgia who meets the conditions set forth in the Law of Georgia on the Legal Status of Aliens and Stateless Persons.
- An asylum seeker for the purposes of issuing a residence permit in Georgia is not considered to be a person lawfully staying in Georgia.
- A residence permit in Georgia is not issued to an alien who, at the moment of submitting an application for a residence permit in Georgia, stays in Georgia on the basis of deferment of the obligation to leave Georgia.
- Residence permit in Georgia (except for investment residence permit, special residence permit and temporary residence permit/residence permit for victims of domestic violence provided for by subparagraph “i” of Article 15 of the Law of Georgia on the Legal Status of Aliens and Stateless Persons) is not issued on the basis of C category ordinary visa.
- Residence permit in Georgia (except for investment residence permit, special residence permit and temporary residence permit/residence permit for victims of domestic violence provided for by subparagraph “i” of Article 15 of the Law of Georgia on the Legal Status of Aliens and Stateless Persons) is not issued to an alien, who stays in Georgia in accordance with the rule established by paragraph 31 of Article 10 of the same Law (to an alien who stays in Georgia on the basis of a visa or/and residence permit of a country defined by the Ordinance 256 of the Government of Georgia dated 5 June 2015).
- An alien lawfully staying in Georgia who has a residence permit provided by the Law of Georgia on the Legal Status of Aliens and Stateless Persons has the right to apply to the Agency for another type of residence permit if he/she meets the requirements established for issuance of a relevant type residence permit.
