How to Plan for Retirement Plan Assets in the Post-COVID/Biden Tax Plan Era
In December 2019 President Trump signed the SECURE Act into law, effective January 1, 2020. Since that time, a surprising number of people have become aware of the new "10-year" payout rule, that there are few exceptions to this brief payout period and the acceleration of income tax, and that Uncle Sam has effectively eliminated the "stretch IRA.” However, most clients (and their advisors) do not know how to effectively deal with or "play in the sandbox" with the SECURE Act. Many clients have heard about certain limited strategies available to counter the effects of SECURE, yet much confusion (and ambivalence) exists despite continued and unprecedented market growth and the enormous wealth represented by qualified plans and IRAs. Furthermore, estate planning for retirement plan assets under SECURE remains a crucial issue as its full impact continues to be understood and interpreted. The new rules not only need to be understood and addressed from a financial and tax perspective, they must be accounted for and addressed in estate plans.
