Solicitation Description:


SCOPE:  In accordance with the provisions of Texas Government Code, Chapter 2166.406, Energy Savings Performance Contracts, and Texas Government Code 2254, Subchapter A, Professional Services, and Rules and Procedures adopted by the Texas Facilities Commission (TFC). TFC is requesting submittal of qualifications to provide prime professional services from Energy Service Companies (ESCOs) that describe their capabilities to identify, assist with procuring financing, design, install, monitor, adjust, and train for a comprehensive utility conservation program.  For the purpose of this RFQ, “ESCO” refers to any entity that is qualified to provide a turnkey utility conservation program that includes the services listed in this request, and meets the requirements of the Attachment G, SECO Energy Saving Performance Contracting Guidelines for State Agencies.  Owner intends to select two ESCOs to perform cost-effective utility conservation retrofits for the selected groups of facilities indicated in Section II.

 

OWNER BACKGROUND: The Texas Facilities Commission’s state-owned property inventory consists of approximately 17.8 million square feet of office space, warehouse and service facilities, parking garages and surface lots located throughout the state.  The Commission provides property management, repair, renovation, routine and deferred maintenance services, and utility services for this inventory.  In the Austin and Travis County area, these holdings primarily reside within three campuses, the Capitol Complex, the North Austin Campus of Health and Human Service Agencies and the Park 35 Campus housing the Texas Commission on Environmental Quality. 

 

TFC’s Office of Energy Management (OEM) program is responsible for identifying and implementing strategies to reduce utility consumption in state-owned facilities within the Commission’s statewide inventory and by doing so, achieve energy and other utility savings while maintaining a healthy, comfortable working environment.  This project has been developed by OEM and will be managed by this division in collaboration with TFC’s Facilities Design & Construction project management program.  The project is intended to contribute to the State’s overall strategy to economically and responsibly control costs and consumption of resources including energy, water, and natural gas utilities.

 

CONTRACT TERM: TFC intends to award two contracts for full prime professional architectural/engineering (A/E) and energy savings performance contracting services for the term of the project. Services undertaken pursuant to this RFQ will be required to commence within ten (10) days of delivery of a Notice to Proceed.  The contract term for Construction is not to exceed one (1) year, and the contract term for payback is not to exceed twelve (12) years from final acceptance of construction.

 

PROJECT DESCRIPTION

·         The selected ESCO will consider all utility and water consumption in the designated facilities for this conservation program. Additionally, the Owner intends to upgrade outdated and obsolete building equipment and perform utility-related facility improvements through the program.  The contract may include installation of the following:

·         Insulation of a building structure and systems within the building;

·         Storm windows or doors, caulking or weather stripping, multi-glazed windows or doors, heat-absorbing or heat-reflective glazed and coated window or door systems, or other window or door system modifications that reduce energy consumption;

·         Automatic energy control systems, including computer software and technical data licenses;

·         Heating, ventilation, or air-conditioning system modifications or replacements that reduce energy or water consumption;

·         Lighting fixtures that increase energy efficiency;

·         Energy recovery systems;

·         Electric systems improvements;

·         Water-conserving fixtures, appliances, and equipment or the substitution of non-water-using fixtures, appliances, and equipment;

·         Water-conserving landscape irrigation equipment;

·         Landscaping measures that reduce watering demands and capture and hold applied water and rainfall, including: landscape contouring, including the use of berms, swales, and terraces, and the use of soil amendments that increase the water-holding capacity of the soil, including compost;

 

·         Rainwater harvesting equipment to make use of water collected as part of a storm-water system installed for water quality control;

·         Equipment for recycling or reuse of water originating on the premises or from other sources, including treated municipal effluent;

·         Equipment needed to capture water from nonconventional, alternate sources, including air conditioning condensate or graywater, for nonpotable uses;

·         Metering equipment needed to segregate water use in order to identify water conservation opportunities or verify water savings; or

·         Other energy or water conservation-related improvements or equipment related to renewable energy or nonconventional water sources or water reuse.

The approximate cost for each group shall not exceed five million dollars ($5,000,000).

 

SCOPE OF SERVICES

Part One - Preliminary Utility Audit: A Preliminary Utility Audit shall be provided, at no cost to the Owner, by the selected ESCO for the facilities listed in the Project Package.  The PUA will itemize the scope of energy saving projects for each individual facility. The itemized project scopes must include cost estimates with simple payback calculations. The cost estimates must include all potential itemized project costs including, but not limited to, design, construction, testing, commissioning, project management, third party design review, third party M & V and review, contingencies, profit, and financing costs.  TFC will review the PUA report and select the proposed projects from the submittals for the scope of the project.

 

Part Two - Loan Application, and Utility Assessment Report Preparation:    A/E services shall be offered with the understanding of full compliance with non-discrimination requirements of the State of Texas.  The ESCO will assist TFC in securing a Texas LoanSTAR (Saving Taxes and Resources) Revolving Loan. The ESCO can propose alternative funding sources for TFC’s evaluation, but the preferred funding source is the SECO LoanSTAR Program.  After TFC’s application is selected for funding the ESCO shall provide the UAR to secure the loan. The UAR Proposal shall include a UAR detail report, a Measurement & Verification Plan, an Implementation Plan, and a sample Periodic Utility Savings Report.  ESCO is responsible for all costs and will not be paid unless UAR is accepted, loan is approved, and contract executed The UAR shall be reviewed and updated by SECO, TFC, and a third party engineer. ESCO will be responsible for updating the UAR to fit SECO’s requirements. TFC will not be liable for compensation to ESCO for UAR if UAR is rejected by SECO and loan not approved.

 

Part Three - Contract and Project Funding: TFC and the funding source shall sign a contract for the loan after TFC and SECO’s mutual acceptance of the UAR.  With funding committed, the contract between TFC and the ESCO will be executed.  Prior to entering into a contract and prior to construction, the ESCO shall provide payment and performance bonds.  The guaranteed savings in the contract shall at a minimum pay for all expenses associated with the execution of the project, employing the ESCO, and all other costs related to third party reviews and measurement & verification.

 

Part Four - Implementation (Retrofit, Commissioning & Training): Upon SECO’s review and TFC’s acceptance of the UAR and execution of the contract, the ESCO shall be given the notice to proceed with the design phase. The ESCO will complete the design under the supervision of TFC, and TFC’s designated review agent.  After the design phase is completed, TFC will review and approve the design documents. TFC will issue a written Notice to Proceed for the implementation of all approved UCRMs specified for the Project with a construction schedule approved by TFC.  All construction and commissioning activities will be coordinated with the Owner’s Project Manager.  Sufficient training will be provided by the ESCO for building maintenance personnel and occupants to successfully operate all UCRMs at maximum efficiency. 

  

Part Five – Post Construction Monitoring, Adjusting, and Reviewing of Savings: For the duration of the contract the ESCO will monitor and adjust, as required, all UCRMs implemented during the performance period.  The Owner retains the right, at the Owner’s discretion, during this phase to discontinue services relieving the ESCO of liability with respect to future savings guarantees.

 

Part Six – Third Party Oversight: TFC will employ an independent third party engineer to review the ESCO’s performance during the performance of the project including, but not limited to, review of the PUA, the UAR, and the design, and on-going measurement and verification of the cost savings resulting from the implemented UCRMs. The ESCO shall cooperate and assist the third-party engineer to conduct the necessary measurement and verification activities. The cost for the third-party engineer must be included in the project cost.

 

MANDATORY PRE-SUBMITTAL TELECONFERENCE: The mandatory pre-submittal conferences will be held as stated in the Schedule of Events. Pre-Registration is required to participate in the teleconference. Respondents must have an employee of their firm attend at least one (1) of the two (2) pre-submittal conferences. TFC shall reject qualification submitted by firms that did not attend one of the mandatory pre-submittal conferences.
