Unlicensed Activity Program

The Unlicensed Activity (ULA) program within the Department of Business and Professional Regulation exists to serve the citizens of the State of Florida by educating them about the dangers of unlicensed activity and investigating complaints filed against unlicensed individuals. The ULA unit works in conjunction with law enforcement and the state attorney’s offices to prosecute individuals practicing without a license. During a declared state of emergency, the penalty for unlicensed activity is elevated from a misdemeanor to a third- degree felony.

Administrative Prosecutions

Individuals formally charged by the department with unlicensed activity through an administrative complaint have the right to have their case heard formally before an Administrative Law Judge with the Division of Administrative Hearings (DOAH). The outcome, including any fine, is imposed by the judge and are within unlicensed activity disciplinary guidelines outlined in Rule 61-5.007, Florida Administrative Code.  Most cases result in Final Order resolutions without going to DOAH.

As of January 1, 2011, all Final Orders issued by the Department of Business and Professional Regulation have been made available on the DOAH website. This database meets the requirements of Section 120.53(1) and (2), Florida Statutes, relating to the indexing and maintenance of agency final orders. To access these orders, visit the website at http://www.doah.state.fl.us and click on “Agency Indexed Orders” to conduct a search. All final orders are accessible and retrievable by searching the subject’s name, document, title, profession, rule, statute, or any other keyword located within the document.
